Negri royal row: DKU secretary to initiate committal proceedings for contempt of court against ruling chiefs


SEREMBAN: Dewan Keadilan dan Undang (DKU) secretary Raja Norazli Raja Nordin will initiate committal proceedings for contempt of court against six individuals, including three ruling chiefs, for defying a High Court order.

Raja Norazli said that although the court had earlier on Friday (June 5) granted ad interim injunctions against the six plaintiffs in an ongoing dispute involving the DKU, restraining them from, among other actions, convening or holding any DKU meeting, including the Special Sitting that had been scheduled for Friday, they had failed to obey it.

"After the ad interim injunction was granted, I have, through media reports, discovered that the plaintiffs, especially plaintiff two, were somehow involved in the so-called proclamation of a Yang di-Pertuan Besar.

"This was reported to have taken place after the High Court granted the ad interim injunctions this morning," he said in a statement.

Raja Norazli said that if the actions by the plaintiffs were found to be true, it would be a violation of the court order.

"The plaintiffs, especially plaintiff number two, may have acted hastily in their attempt to defy a court order.

"My lawyers have written to their lawyers wherein I have reserved my right to initiate proceedings against the plaintiffs to preserve the integrity of this honourable court's order," he said.

Earlier on Friday, Judge Roz Mawar Rozain granted the injunctions upon an application by Raja Norazli, and the DKU, named the first and second defendant, respectively.

An ad interim injunction is a temporary court order intended to preserve the status quo until the court is able to hear and determine the matter in greater detail.

The six plaintiffs are Datuk Mubarak Dohak, Undang of Jelebu Datuk Maarof Mat Rashad, Undang of Johol Datuk Muhammed Abdullah, Undang of Rembau Datuk Abdul Rahim Yasin, Tunku Besar of Tampin Tunku Syed Razman Tunku Syed Idrus Al-Qadri, and Shahbandar of Sungei Ujong Datuk Seri Badarudin Abdul Khalid.

In a statement issued on behalf of the defendants, it was stated that the court order prohibits the plaintiffs, whether acting personally or through any servant, agent, nominee or appointee, from convening or holding any DKU meeting.

The plaintiffs were also restrained from suspending, removing, replacing or otherwise interfering with Raja Norazli in the performance of his duties and functions as Secretary of the DKU, pending further court proceedings.

In addition, the plaintiffs are prohibited from establishing or empowering any committee, person or body to assume the powers and functions of the DKU secretary, as well as from taking, making or implementing any decisions relating to the administration, governance, proceedings and affairs of the DKU.

The order further restrains the plaintiffs from "otherwise taking any step that alters or interferes with the status quo of the DKU as it stood immediately before May 21.

The injunctions will remain in force pending the hearing and determination of issues relating to jurisdiction and justiciability, and thereafter until further order of the court.

With the injunctions in place, the plaintiffs are barred from removing Raja Norazli as DKU secretary, conducting any affairs on behalf of the DKU, or issuing press statements concerning matters related to the body.
