Reports not ready, so new court date set for DUI case involving cop's death


SEREMBAN: Jan 16 has been fixed for mention of the case involving a 26-year-old lorry attendant accused of driving under the influence of alcohol and causing an accident that claimed the life of a policeman on duty.

Magistrate Nurul Azuin Talhah set the date on Thursday (Dec 11) after deputy public prosecutor P. Rubini told the court that the forensic report of a CCTV recording and the criminalistics report were not ready.

"The other documents have been handed over to the defence, but other reports are not ready

"We hereby seek another mention date (to hand over the reports)," she said.

On Aug 22, K. Kelvin Raj had claimed trial to a charge of having an excessive level of alcohol in his bloodstream while driving.

This allegedly resulted in the death of 23-year-old Naim Mullah Mohd Affandi when the accused's car allegedly hit the victim, who was riding his motorcycle on Jalan Temiang near here at 1.25am on Aug 18.

The victim was attached to the Jalan Campbell station.

Kelvin Raj was charged under Section 44(1)(b) of the Road Transport Act 1987 for causing death or injury while driving under the influence.

The offence carries a jail term of 10 to 15 years and a fine of RM50,000 to RM100,000 upon conviction.

The offender can also be barred from holding a driving licence for a minimum of 10 years.

The accused was released on bail of RM5,000.
