Magistrate sets hearing date for alcohol-related death of on-duty officer


SEREMBAN: The Magistrate's court has scheduled Dec 11 for the next hearing in a case involving a 26-year-old lorry attendant accused of driving under the influence of alcohol, which led to the death of an on-duty policeman.

Magistrate Nurul Azuin Talhah made the decision to allow the accused K.Kelvin Raj to appoint counsel on Thursday (Oct 16).

On Aug 22, K. Kelvin Raj had claimed trial to a charge of having excessive alcohol in his body while driving. This resulted in the death of 23-year-old Naim Mullah Mohd Affandi when the accused's car allegedly hit the victim, who was riding his motorcycle on Jalan Temiang near here at 1.25am on Aug 18

The victim was attached to the Jalan Campbell station.

Kelvin Raj was charged under Section 44(1)(b) of the Road Transport Act 1987 for causing death or injury while driving under the influence.

It carries a jail term of 10 to 15 years and a fine of RM50,000 to RM100,000 upon conviction.

The offender can also be barred from holding a driving licence for a minimum of 10 years.

The accused was released on bail of RM5,000.
