Bandar Utama school murder: Psych report on accused not ready, case put off to Dec 19


PETALING JAYA: The psychiatric report for a male student who allegedly stabbed a female schoolmate to death is still pending, a Magistrate's Court here was told.

Lawyer Kitson Foong, representing the underage accused, informed Magistrate Amira Sariaty Zainal of this in closed proceedings on Friday (Nov 21).

When met by the press later, Foong said that the court has the power to extend the time under Section 34(2) of the Criminal Procedure Code for the psychiatric report to be ready.

"The proceedings have been postponed to Dec 19 in the hopes that the report would be ready by then," he said.

According to the lawyer, the first assessment needed was for his client's mental fitness to record a plea and to be tried.

The second assessment was to determine his state of mind during the alleged offence, Foong added.

On Oct 22, the 14-year-old student was charged with committing the murder at a school in Bandar Utama.

According to the charge sheet, the teenager allegedly murdered the 16-year-old in a female student toilet between 9.20am and 9.35am on Oct 14.

The charge, under Section 302 of the Penal Code, carries a death sentence, or imprisonment for between 30 to 40 years and 12 strokes of the cane, if convicted.

The court ordered the accused to undergo a psychiatric evaluation at Hospital Bahagia Ulu Kinta in Perak.
