Land disputes a big hurdle for Malay reserve projects


THE overlapping land ownership issue is one of the biggest hurdles preventing redevelopment efforts for Malay reserve land, says Datuk Seri Dr Zaliha Mustafa (pic).

The Minister in the Prime Minister’s Department (Federal Territories) cited the overlapping land ownership of Malay reserve land in the city, where 256 individuals had overlapping claims over a plot of land measuring 8,700sq ft.

“Part of the Malay reserve land is inherited from generation to generation. This has resulted in a plot of land owned by up to hundreds of individuals registered under shared ownership.

“The commercial or redevelopment process could fail if even one owner disagrees with the offer,” she told the Dewan Rakyat yesterday.

Dr Zaliha said this in a reply to Datuk Azman Nasrudin (PN-Padang Serai) to explain the reasons for development challenges on Malay Reserve Land in Kuala Lumpur, citing overlapping ownership and limited market value.

She said the future market value of Malay reserve land is limited because of restrictions on interest, prohibiting the transfer of ownership to non-Malays.

Such a situation also directly limits investor and property market interest in completed units for sale, she added.

“Meanwhile, most Malay reserve land areas in Kuala Lumpur are located in strategic locations and will incur high development costs if developed, for example, in the Sungai Penchala Malay reserve,” she said.

As of this year, Dr Zaliha said the total area of ​​Malay-reserve land in the Federal Territory is 1,004ha.

This includes the Segambut and Selayang Malay reserve lands in Batu, as well as the Sungai Penchala and Taman Desa lands in Kuala Lumpur, in addition to the Gombak Malay Reserve in Setapak.

She also said that Kampung Baru in the capital was reserved as a Malay Agricultural Settlement (MAS) area and gazetted on Jan 12, 1900, using the provisions of Section 6, Land Enactment 1897, through the MAS (Kuala Lumpur) Rules 1950.

Such provisions, she said, do not subject Kampung Baru to the Malay Reserve Enactment.

She said a briefing on the redevelopment will be presented at the Dewan Rakyat on Thursday.
