FashionValet received RM19.6mil from Khazanah in 2018, court told


KUALA LUMPUR: A sum of RM19.6mil was transferred from Khazanah Nasional Bhd (Khazanah) into FashionValet Sdn Bhd in two transactions in 2018, the Sessions Court heard.

CIMB Bank branch manager Lee Hui Nee, 58, testified that this was based on Khazanah's bank statement with CIMB for March 2018.

The first transfer of RM7,848,000 went to FashionValet on March 23, 2018, and another RM11,742,000 was transacted on March 26 that year.

"The total for both transactions was about RM19,590,000. For the record, the payment for both transactions was done through interbank transfer and was fully processed by the bank," she said in her witness statement here on Tuesday (Aug 18).

The witness stated that based on Khazanah's bank statement between Jan 31, 2017, and Dec 31, 2019, only two transactions to FashionValet occurred in March 2018.

Lee, who is the fourth prosecution witness, was testifying in the trial of FashionValet founders, Datin Vivy Yusof and her husband Datuk Fadzarudin Shah Anuar, who are facing charges of criminal breach of trust involving RM8mil in investment funds from Khazanah and Permodalan Nasional Bhd (PNB).

Lee, who was under cross-examination by Vivy's lawyer Shaarvin Raaj Selva Kumar, also told the court that based on bank statements, there were two transactions linked to Vivy and Fadzarudin occurring before and after the transaction to FashionValet on March 23, 2018. However, the nature and amount of those two transactions were not disclosed.

Shaarvin: On March 23, 2018, before the funds were transacted to FashionValet, there was also a transaction to FashionValet's director, Vivy Yusof. Agreed?

Lee: I agree.

Shaarvin: After the transaction to FashionValet on March 23, 2018, there was also a transaction to FashionValet's director, Fadzarudin. Agreed?

Lee: I agree.

Shaarvin: But your job is only to identify the transactions relating to FashionValet. Agreed?

Lee: I agree.

The witness was then asked during a re-examination by Deputy Public Prosecutor Haresh Prakash Somiah whether she knew details of the two transactions to Vivy and Fadzarudin on March 23, 2018.

"I don't know (the details). When the lawyer referred me to the (bank) statement. I saw on the statement these two names, but I did not know that they were FashionValet directors.

"So, my answer is based on the statement before my eyes," Lee explained.

Meanwhile, Companies Commission of Malaysia (SSM) assistant registrar R. Harshini, 36, who was the third prosecution witness, testified that a check on the director status for FashionValet and 30 Maple Sdn Bhd showed that both Vivy and Fadzarudin were directors of the two fashion companies in 2018.

Vivy and Fadzarudin were accused, in their capacity as company directors, of dishonestly making a payment of RM8mil from FashionValet to 30 Maple without the approval of FashionValet's board of directors. The offence was allegedly committed at a Public Bank branch in Bukit Damansara on Aug 21, 2018.

The charge under Section 409 of the Penal Code carries imprisonment between two and 20 years, whipping and a fine, if convicted.

The hearing continues before Judge Rosli Ahmad on Oct 16.
