KUALA LUMPUR: A sum of RM8mil was deposited into the bank account of 30 Maple Sdn Bhd through two transactions from FashionValet Sdn Bhd's bank account eight years ago, the Sessions Court told.
CIMB Taman Tun Dr Ismail branch customer service manager Azizan Hassan, 45, testified that based on 30 Maple's bank account statement, there were RM5mil and RM3mil transactions from FashionValet's bank account that were done online.
According to the witness the RM5mil remittance from FashionValet to 30 Maple was transacted on Aug 21, 2018, with 30 Maple's bank balance being RM2,678,853.48 prior to the transaction.
“On the same date, there was another incoming transaction of RM3mil from FashionValet. I confirm that the balance (in 30 Maple's account) was RM7,678,853.48 prior to the RM3mil transaction,” she said in her witness statement here on Monday (July 20).
Azizan is the first witness on the stand on the first day trial of FashionValet founders, Datin Vivy Yusof and her husband Datuk Fadzarudin Shah Anuar, who are facing charges of criminal breach of trust involving RM8mil in investment funds from Khazanah Nasional Bhd (Khazanah) and Permodalan Nasional Bhd (PNB).
The court was also told that based on 30 Maple's bank statement, there was a withdrawal amounting to RM10,213,537.28 from its bank account on Sept 3, 2018.
“There was an incoming transaction of RM5mil on the same date (Sept 3, 2018) and a withdrawal of RM5mil on Sept 4, 2018 with the description 'Interim Dividend FADZARUDIN SHAH',” Azizan said.
The witness also confirmed that the signatories for 30 Maple were Vivy and Fadzarudin Shah.
Vivy and Fadzarudin were accused, in their capacity as company directors, of dishonestly making a payment of RM8mil from FashionValet Sdn Bhd to 30 Maple Sdn Bhd without the approval of FashionValet's board of directors. The offence was allegedly committed at a Public Bank branch in Bukit Damansara on Aug 21, 2018.
They were jointly charged under Section 409 of the Penal Code, read together with Section 34 of the same Code. If convicted, Vivy and Fadzarudin face imprisonment of between two and 20 years, whipping and a fine.
The hearing resumes on Friday (July 24) before Sessions Court judge Rosli Ahmad.
