KUALA LUMPUR: The Sessions Court here has allowed an application by FashionValet Sdn Bhd founders Datin Vivy Yusof and her husband Datuk Fadzarudin Shah Anuar to obtain temporary access to their passports for Haj visa purposes.
Sessions Court Judge Rosli Ahmad allowed the application to release the passports from today until next Monday (March 9).
"The passports will be released to the two applicants today and the applicants must return it to the court on March 9," he said here on Friday (March 6).
Earlier, lawyer Shaarvin Raaj told the court that the couple was seeking their passports to do their visa applications, after which they would be booking tickets to go to Mecca for Haj.
Deputy Public Prosecutor Noor Syazwani Mohamad Sobry said the prosecution was informed on the matter and did not object to the application.
On Dec 5, 2024, Vivy and Fadzarudin were jointly accused of fraudulently making a payment of RM8mil from FashionValet Sdn Bhd to 30 Maple Sdn Bhd without the approval of the FashionValet board of directors.
According to the charge sheet, Vivy and Fadzarudin, in their capacity as company directors, were entrusted with the monies which were investment funds from Khazanah Nasional and PNB.
The offence was allegedly committed at a Public Bank branch in Bukit Damansara on Aug 21, 2018.
They were charged under Section 409 of the Penal Code, read together with Section 34 of the same Code.
If convicted, Vivy and Fadzarudin face imprisonment of between two and 20 years, whipping and a fine.
