SEREMBAN: The Attorney General's Chambers has rejected a 34-year-old religious school teacher's representation to review the charges against him, after being accused of committing sexual assault against two children.
Deputy Public Prosecutor Norazihah Asmuni told this to Sessions Court judge Surita Budin when the matter came up for mention Tuesday (Dec 16).
The accused had claimed trial to the charges.
For the first charge, the accused allegedly committed the act against the victim, who was then 12 years old, at a madrasah in Lenggeng in 2023.
For the second charge, he allegedly committed the same act against the victim around 4.30am in February 2024.
The accused was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries a jail term not exceeding 20 years and whipping.
For the third charge, he had allegedly committed the offence against an eight-year-old boy at the same madrasah in 2023.
He was initially charged under Section 14(b) of the Sexual Offences Against Children Act 2017, which carries a jail term not exceeding 20 years and whipping.
Norazihah told the court that the prosecution has also amended the second charge to Section 377C of the Penal Code for carnal intercourse against the order of nature.
Offenders can be jailed between five and 20 years and whipped upon conviction.
Judge Surita then fixed Jan 12 for case management and to hear the outcome of the second appeal to be filed by the defence.
Trial was fixed for Jan 19 to 23.
