PETALING JAYA: The Paris Court of Appeal has annulled in its entirety the purported “Final Award” rendered by Gonzalo Stampa on Feb 28, 2022 and ordered the so-called Sulu claimants to pay EUR200,000 (RM957,140) in costs to Malaysia.
According to the Sulu Special Secretariat War Room, which stated for and on behalf of the Malaysian government on Wednesday (Dec 10), the Court in its decision on Tuesday (Dec 9) had affirmed that Stampa lacked jurisdiction to render the purported award as there was no valid arbitration agreement binding Malaysia.
“As a result, the Court annulled the purported ‘Final Award’ in its entirety. Malaysia trusts that his victory will put an end to all the baseless attempts from the so-called Sulu claimants (and their litigation funder to extort money and assets from the people of Malaysia.
“In any event, Malaysia stands ready to continue the fight before any court called upon by the so-called Sulu claimants,” the Sulu Special Secretariat War Room said.
It added that on June 6, 2023, the Paris Court of Appeal had already refused the recognition and enforcement of the purported “Partial Award” issued by Stampe on May 25, 2020, on the same ground.
Subsequently, on Nov 6, 2024, the French Supreme Court fully dismissed the challenge filed by the so-called Sulu claimants against the decision by the Paris Court of Appeal.
