Father claims trial to hurting teenage daughters in Seremban


SEREMBAN: A 40-year-old man has claimed trial at separate courts here to charges of causing injury to his two daughters.

The accused first pleaded not guilty at the Sessions Court to a charge of using a piece of wood to hit his 17-year-old daughter at their house in Taman Bukit Ampangan near here.

He was charged with committing the offence around 4pm on Feb 25.

The accused was charged under Section 324 of the Penal Code for voluntarily causing hurt by dangerous weapons or means, read together with Section 326A.

The offence carries a jail term of up to 10 years, or a fine, or whipping upon conviction.

Section 326A provides for a prison term twice as long as the maximum term under Section 324.

Deputy public prosecutor Nurul Balkis Zunaidi then asked the court for a mention date to allow the accused to appoint a lawyer and to allow her team to file the relevant documents.

She said the prosecution was not offering bail but if the court were to allow it, then the amount should be high due to the seriousness of the offence.

The accused asked for a lower amount as he did not earn much working as a labourer at a mining company.

He told judge Surita Budin that he was also the sole breadwinner of the family as his wife who was a foreigner, was unable to seek employment.

He also had to provide for his seven children, two of whom were pursuing courses at institutions of higher learning.

He told the court that he did not have a fixed income due to the nature of his employment.

Judge Surita then asked the DPP the injuries suffered by the victim and was told that she had swelling on her shoulder, arms and legs.

Surita then set bail at RM9,000 with one surety and fixed April 18 for mention.

She also reminded the accused to stay away from the victim who was currently under the care of a relative and eyewitnesses.

He later also claimed trial at the Magistrate’s Court to a charge of causing injury to another daughter, aged 14, at the same place and time with his hands and legs.

He was charged under Section 323 of the Penal Code read together with Section 326A of the same legislation which carries a jail term of up to one year or a fine of up to RM2,000 or both upon conviction.

DPP Norshafatihah Nor Azmi told the court magistrate Nurul Saqinah Rosli that her team was offering the accused a bail of RM8,000 and that he should be ordered to stay away from the alleged victim and eyewitnesses.

He told magistrate Nurul Saqinah Rosli that he was facing financial problems and would not be able to raise the amount.

The court then set bail at RM3,500 with one surety and fixed April 18 for next mention.

He was also told not to contact the victim and eyewitnesses.
