SEPANG: "Please, I beg to be released on bail, I have children who need to go to school."
This was the plea of actor Along Cham after Judge Ahmad Fuad Othman did not allow the accused to be granted bail on Friday, reported Sinar Harian.
During the proceedings at the Sessions Court here, Along, whose real name is Muhammad Nizamudin Ahmad, 41, pleaded not guilty to a charge of possessing cannabis weighing approximately 58.23g at a house in Cyberjaya here at 3.10pm on Dec 14.
He was charged under Section 6 of the Dangerous Drugs Act (DDA) 1952, which is punishable under Section 39A(2) of the same act.
If found guilty, the accused could face between five years jail and life imprisonment, as well a minimum of 10 strokes of the cane.
Following this, Deputy Public Prosecutor Ahmad Zuhaini Mahamad Amin did not propose for the accused to be granted bail.
Shocked by the situation, the presenter and radio announcer pleaded to be released on bail since his family had appointed a lawyer to represent him.
Muhammad Nizamudin: I was supposed to be remanded for four days, but I was only informed that I would be charged today, so it's a bit chaotic.
Judge: Where is your lawyer?
Muhammad Nizamudin: My family has contacted and informed me that they have appointed a lawyer.
Judge: The legal provisions state that this case is not bailable.
Muhammad Nizamudin: I plead, I promise, I swear I will cooperate.
Judge: This case is not bailable; if the legal provisions stated it could be bailed, I could consider it.
Meanwhile, lawyer Mohd Fadly Hashim introduced himself and apologised for entering the court late.
The court then set proceedings for the submission of the chemical report for Jan 27 next year.
According to the charge, he was accused of having in his possession a substance suspected to be dangerous drugs, namely cannabis, weighing approximately 58.23 grams, at a house in Cyberjaya here, at 3:10 p.m. on December 14.
The charge is made under Section 6 of the Dangerous Drugs Act (DDA) 1952, which is punishable under Section 39A(2) of the same act, carrying a sentence of life imprisonment or not less than five years, and whipping of not less than 10 strokes, if convicted.
Meanwhile, he pleaded guilty in the Magistrate's Court to a charge of possessing a substance suspected to be dangerous drugs, namely cannabis, weighing approximately 2.07g, at the same location, time, and date.
He was charged under Section 6 of the DDA 1952, which carries a fine of not more than RM20,000 or a maximum of five years' imprisonment or both, if convicted.
In this case, Magistrate Muhammad Bukhori Md Ruslan allowed the actor from the film 'Bro, Nampak Motor Gua?' to be granted bail of RM2,500 and set the proceedings for the submission of the chemical report for Feb 28 next year.
