KUALA LUMPUR: A Sessions Court was told that the Attorney General’s Chambers (AGC) has not decided on the third representation by Crackhouse Comedy Club owner Mohamad Rizal Van Geyzel (pic), who is seeking to have his three charges of posting offensive content on social media dropped.
Deputy public prosecutor Noor Haslinda Che Seman informed Sessions Court judge Priscilla Hemamalini Nadarajan that the AGC had received the representation filed by Mohamad Rizal on June 7.
“The AGC is still looking into it. So far, there is still no decision and we request another date to inform the court of the decision on the representation,” she said during the mention of the case here yesterday.
Mohamad Rizal’s lawyer M. Pravin confirmed the matter.
Judge Priscilla then fixed June 26 for the prosecution to update the court on the outcome.
Mohamad Rizal, 40, had sent in his first representation, which was dismissed by the AGC on Jan 20.
His second representation was dismissed on May 31.
He was charged with uploading the content on his Facebook, Instagram and Tik Tok accounts on July 4, July 5 and July 6 last year respectively, with the intention to annoy others.
The content was viewed at the cyber and multimedia crimes investigation division of the Commercial Crimes Investigation Department at the Bukit Aman on July 13, 2022.
Mohamad Rizal was charged under Section 233(1)(a) of the Communications and Multimedia Act, an offence punishable under Section 233(3) of the same Act.
He faces a maximum fine of RM50,000, up to one year of imprisonment, or both.
