PONTIAN: An ice lorry driver pleaded guilty at the Magistrate's Court here to five charges involving breaking into three National Information Dissemination Centre (Nadi) premises and disposing of stolen items to destroy evidence.
Muhammad Haziq Elvy Rimow, 43, faced the charges before magistrate Nurhafiza Haron at the Pontian Court building on Thursday (Jan 8).
For the first charge, he was accused of breaking into a Nadi premises at Balai Raya Bandar Permas in Kukup with the intention of committing an offence at about 11.31pm on May 15 last year.
The act constitutes an offence under Section 447 of the Penal Code, which carries a maximum sentence of six months’ jail or a fine of up to RM3,000 or both upon conviction.
He was also accused of breaking into a second Nadi premises in Taman Nilam, where valuable items were kept, with the intention of committing a criminal offence at about 2am on Dec 6.
The offence falls under Section 448 of the Penal Code, which carries a maximum penalty of three years’ jail or a fine of up to RM5,000 or both upon conviction.
He was further charged with breaking into a third Nadi premises at Batu 1 near Sungai Pinggan at about 12.42am on Dec 25, an offence under Section 457 of the Penal Code. Upon conviction, Section 457 provides for imprisonment of up to five years and a fine.
Muhammad Haziq also faced two charges of disposing of stolen property, namely CCTV decoders belonging to Nadi Parit Sapran and Peladang Pekan Nanas. Both offences were committed in Parit Pasir near Jalan Sawah and at Jalan Parit Sikom in Kayu Ara Pasong between noon and 1pm on Dec 29 last year.
He pleaded guilty to all five charges.
Nurhafiza sentenced him to six months’ imprisonment for the first charge and 12 months’ imprisonment for the remaining four charges. However, she ordered the sentences to run concurrently from the date of his arrest on Dec 27.
Deputy public prosecutor Anis Sahira Rosley prosecuted, while the accused was represented by National Legal Aid Foundation (YBGK) lawyer Zulyatie Awang.
