Najib to appeal dismissal of house arrest bid


KUALA LUMPUR: Datuk Seri Najib Razak will file an appeal against the High Court's dismissal of his judicial review in an attempt to serve the remainder of his jail term in the RM42mil SRC International Sdn Bhd case under house arrest.

Shortly after Justice Alice Loke delivered her decision here on Monday (Dec 22), Najib's lead counsel Tan Sri Muhammad Shafee Abdullah stood up and informed the court of the applicant's intention to appeal.

"We've been given the instruction to appeal," he told the judge.

Shafee sought that the court expedite its written judgment, to which Justice Loke replied that it would assist in the matter.

"I can oblige. Thank you, counsel," she said

Earlier, the High Court dismissed Najib's judicial review on the grounds that the addendum order did not comply with Article 42 of the Federal Constitution, and consequently became invalid.

"Conversely, the applicant has no right to the relief of mandamus. The judicial review is therefore dismissed," Justice Loke said.

The court did not make any order as to costs.

Former prime minister Najib is currently serving a six-year jail sentence for abuse of power, criminal breach of trust and money laundering involving RM42mil siphoned from SRC International, a former 1MDB subsidiary.

He has exhausted all appeals to overturn his conviction and sentence.

He had asked the court to verify whether or not an alleged addendum order – supposedly issued by former Yang di-Pertuan Agong Sultan Abdullah Sultan Ahmad Shah and granting him house arrest – is genuine.

On Feb 2 last year, the Pardons Board reduced Najib’s original 12-year jail term and RM210mil fine to six years’ imprisonment and a RM50mil fine.
