Labourer gets 26 years' jail, 10 strokes for raping 16-year-old stepdaughter


SIBU: A labourer has been sentenced to 26 years in prison and 10 strokes of the cane for raping his 16-year-old stepdaughter twice in June.

Sessions Court judge Musyiri Peet on Tuesday (Oct 7) handed down 13 years' imprisonment and five strokes of the cane for each charge under Section 376B of the Penal Code, read with Section 16 of the Sexual Offences Against Children Act 2017.

The court ordered the sentences to be served consecutively.

This new sentence will begin only after the accused, 31, completes a separate 30-year prison term imposed by the Sessions Court on Sept 3 for two other rape convictions involving the same victim.

Judge Stella Augustine Druce had sentenced him to 30 years in prison and 14 strokes of the cane for those earlier counts.

The accused committed the offences on June 1 and June 14, between 6pm and 11.59pm, at a longhouse in Kanowit.

The case came to light when the victim and her 11-year-old sister fled their longhouse on July 9, stating they could no longer endure the abuse.

The victim was taken to hospital on Aug 20 complaining of stomach pain, where a doctor confirmed she was six months pregnant.

Police investigations revealed the victim had first been raped by the accused in January 2020 whilst she was asleep in her room, with the abuse continuing for years.

DPP Cynthia Emmelda Jerry prosecuted, whilst the accused was not represented by legal counsel.
