Magistrate's Court sets Sept 10 for representation decision in reckless driving case


The accused being taken away after the court was told that the prosecution had yet to get a reply on the representation filed by his defence team

SEREMBAN: The Magistrate's court here has fixed Sept 10 to hear the outcome of a representation filed by a 17-year-old car driver facing three charges of causing the deaths of three young motorcyclists due to reckless driving.

Magistrate Saiful Sayoti made the decision after the court was told the prosecution had yet to get a reply on the representation filed by the defence.

Lawyer for the accused Johan Radzi told this to reporters when met outside the court as the proceedings were heard in camera.

The accused claimed trial when charged on April 22, with committing the offence at the Taman Matahari junction along Jalan Persiaran Senawang 1 near here around 8.30pm on March 6.

He was charged with causing the deaths of Muhammad Aidil Ramdan Abdullah, 15, Muhammad Aswari Lotpi, 16 and Aisar Azim Abdullah, 17.

The charge under Section 41(1) of the Road Transport Act 1987 carries a jail term of between five and 10 years and a fine of between RM20,000 and RM50,000 upon conviction.

The accused had also claimed trial to another charge of driving without a valid license.

He was charged under Section 26(1) of the same Act, which carries a fine of between RM300 and RM2,000 or imprisonment of up to three months or both upon conviction.

He had also filed a representation for the charge.

On May 21, Johan had told the court of his client's intention to file a representation to have the charges against him reviewed.
