Disabled motorcyclist jailed a week fined RM10,000 for drink riding

KOTA KINABALU:, A 27-year-old man, who is a disabled person card holder, was jailed seven days and fined RM10,000 for riding a motorcycle under the influence of alcohol on Oct 5 last year.

Mohd Azrey Rhyme was sentenced after he pleaded guilty before Tawau Magistrate Don Stiwin Malanjum on Wednesday (Feb 12).

The charge was framed under Section 45A(1) of the Road Transport Act 1987, which provides for a maximum jail term of two years and fines of up to RM30,000.

Magistrate Malanjum ordered him to serve three months in prison if he fails to pay the fine while disqualifying him from holding a driving licence for two years.

Based on the evidence submitted to the court, Mohd Azrey was accused of committing the act at about 11.20pm on Oct 5 when he was detained at a roadblock in Jalan Chong Thien Vun in Tawau.

The result of the breathalyser test found that the alcohol content in his blood was 107mg of ethyl in 100ml of blood, exceeding the permitted limit.

Mohd Azrey, who was also charged under Section 26(1) of RTA 1987 for riding a motorcycle without a licence and the vehicle was not insured.
