KOTA KINABALU: A university student has been ordered to perform eight months of community service for reckless driving that caused the death of a motorist five years ago.
Oi Yi Li, 26, was asked to fulfil four hours of a Compulsory Attendance Order (CAO) every day, in default three months' jail.
Kota Kinabalu Magistrate Stephanie Sherron Abbie delivered the decision on Wednesday (May 10) after a full trial where five witnesses were called at the prosecution stage.
Oi was found guilty of driving recklessly which caused the death of a 55-year-old man at around 5am on Aug 26, 2018, near the Jalan Tunku Abdul Rahman traffic lights here.
Counsel Kimberly Ye and Chen Wen Jye represented Oi while traffic prosecuting officer Khairul Nizam appeared for the prosecution.
In asking for leniency during mitigation, Ye said the accused was a first-time offender and was only 21 years old at the time of the incident.
She said Oi’s sentence should be reformative and rehabilitative, adding that her client was still studying and doing well in university.
In return, the prosecution urged the court to impose an appropriate sentence as there was enough evidence to prove Oi had been negligent to the point of causing the death of a motorist, among other things.
