KUALA LUMPUR: PKR is investigating whether the sole party representative in the Kelantan state assembly voted in favour of amendments to the Syariah Criminal Code II 1993 to pave the way for hudud to be implemented in the state.
Guchil assemblyman Roslan Puteh is the sole representative of PKR in the state assembly.
"We instructed him not to be there (at the Kelantan state assembly) and not to participate," PKR secretary-general Rafizi Ramli told reporters outside Parliament on Thursday.
"He was not there yesterday (Wednesday) (during the tabling) but whether he was there today, we will check," Rafizi added.
There are 44 assemblymen including 31 representatives from PAS, and 12 from Umno.
Amendments to the enactment were passed by the state assembly in Kota Baru on Thursday via a voice vote.
The amendments were passed at 12.05pm after more than two and a half hours of debates by four state assemblymen and two winding-up speeches including one by Mentri Besar Datuk Ahmad Yaakob.
PKR and DAP leaders had disagreed with the amendments when they were presented at a special briefing by PAS last week.
PAS was urged to reconsider the proposed amendments by its Pakatan allies but the party had gone ahead with the tabling.
For hudud law to be enforceable in Kelantan, the Syariah Courts (Criminal Jurisdiction) Act and Article 76A(1) of the Federal Constitution have to be amended.
PAS is expected to do this through two Private Member’s Bills in Parliament.
Seven key aspects of the laws, among others were increased rotan lashes of up to 100 for illicit sexual intercourse, consumption of intoxicating beverages, theft and robbery.
Hudud law does not apply to non-Muslims. This follows an amendment to the code that previously gave non-Muslims an option to choose hudud or to be tried under conventional laws.
