A TAXI driver who bought a limited-edition motorcycle was awarded RM3,500 by the Johor Consumer Claims Tribunal on a claim that the vehicle is not in working condition.

Muhammad Sairul Kunchi Maidin Kutti said he has been looking forward to owning the motorcycle, which was marketed as one of only 1,000 units in Malaysia.

However, the 34-year-old said the motorcycle had remained idle at his house because of mechanical problems.

“I became interested in buying the motorcycle after coming across an advertisement on social media on March 12,” he said when met outside the Tribunal in Johor Baru.

Muhammad Sairul, who lives in Taman Senai Baru, Senai, said he went to a motorcycle dealer in Taman Nusa Perintis 2, Gelang Patah, on March 13.

He signed a purchase agreement for the RM9,780 motorcycle on a four-year loan.

The monthly instalments were RM280 until 2030, bringing the total repayment amount close to RM13,500, he added.

“I also paid RM400 for a specific number plate. I was owner number 387 out of the 1,000 owners in Malaysia,” he said.

Muhammad Sairul said the dealer told him to wait three days for the motorcycle to be delivered from the factory in Shah Alam, Selangor.

However, the motorcycle did not arrive on March 16, as promised.

When he reached out to the dealer, he was told the motorcycle would arrive on March 30 instead.

Muhammad Sairul then contacted the main dealer in Pekan Nanas, Pontian, to cancel the purchase as the motorcycle had not been delivered as promised.

“About 10 minutes later, the person called back and asked me to come to Pontian on April 4, saying the motorcycle would be available then,” he said.

Muhammad Sairul said the motorcycle he received did not appear to be in new condition.

“The body cover was loose, there were problems with the brake lever and the tyre rims were faded.

“When I rode the motorcycle home from Pontian to Senai, it stopped after about 5km,” he said.

He added that the motorcycle was later sent to a service centre in Shah Alam for repairs.

Muhammad Sairul said he took possession of the motorcycle on April 27, but the problem persisted.

“Until now, there are still problems with the brake system and engine,” he said.

Tribunal president Hafez Zalkapli awarded Muhammad Sairul RM3,500 instead of the RM9,780 claimed, and ordered the respondent to refund the amount within two weeks.

“The Tribunal could not award RM9,780 as the claimant already has to service the loan and he is now the owner of the motorcycle,” Hafez said.
