Two policemen in Shuhaily case to file civil suit

SEPANG: Two policemen, allegedly assaulted by Malaysian Border Control and Protection Agency (AKPS) director-general Comm Datuk Seri Mohd Shuhaily Mohd Zain, will be filing a civil suit within the week.

Lawyer Kamal Hisham Jaafar, who represents the policemen, said action would be taken to seek compensation for the physical injuries and psychological impact suffered by L/Kpl Muhammad Ekmal Sofwan Dirman and L/Kpl Mohamad Faiz Saman.

“We undertake to file the action in court within seven days,” he told reporters after the proceedings at the Sepang Court Complex yesterday.

“I am handling the case myself on a pro bono basis.

“I am not charging either officer any fees,” Kamal said, adding that he had also denied social media claims that a cartel or other parties were financing their legal representation.

He urged the public to stop speculating about alleged syndicate links or “counter setting” involving the officers, stressing that such claims were unrelated to the incident forming the basis of the court charges.

Meanwhile, Comm Mohd Shuhaily’s lawyer Datuk Rosal Azimin Ahmad said the AKPS chief was expected to continue carrying out his duties unless instructed otherwise by the relevant authorities.

He said there was currently no court order preventing Comm Mohd Shuhaily from performing his duties, adding that any decision concerning his service status would fall under the purview of the Home Ministry and the Public Service Department.

Rosal also said nine lawyers were representing Comm Mohd Shuhaily, with the team led by Kitson Foong.

He added that Comm Mohd Shuhaily was in good spirits and had accepted the situation without blaming anyone.

“He said, ‘It’s okay, I’ll face it. If this is the price I have to pay, then I have to pay it,’” Rosal said.

He added that the defence team was awaiting documents under Section 51A of the Criminal Procedure Code before deciding on its next course of action, including possible representations.

He also urged the public to respect the principle that an accused person is innocent until proven guilty.
