PETALING JAYA: Perikatan Nasional has formed a legal team to study possible legal action against the Registrar of Societies (ROS) following the suspension of all activities by the coalition.
According to Sinar Harian, Perikatan secretary-general Datuk Seri Takiyuddin Hassan said the team was examining the appropriate legal avenues, including the possibility of seeking an injunction or a declaration challenging the validity of the ROS decision.
He said Perikatan’s lawyers would meet in Kuala Lumpur to determine the appropriate course of action.
“Tomorrow, we will have a meeting with the lawyers in Kuala Lumpur.
“We will decide on the appropriate action, whether to seek an injunction or a declaration on whether the ROS decision is valid or not,” he said after officiating the Bunut Payung state constituency’s Karnival Cakna Rakyat at Lembah Sireh here on Saturday (Sept 26).
Takiyuddin said the legal action followed ROS’ decision to suspend all Perikatan activities from Wednesday.
He also explained the circumstances surrounding a complaint by Bersatu, including the Perikatan supreme council meeting on July 16.
He said Bersatu had announced on July 15 that it intended to use its own logo in the Negri Sembilan state election, while Perikatan held a meeting the following day to discuss cooperation with Barisan Nasional and seat allocations.
“So they no longer wanted to be with Perikatan.
"Why would we call them again? They asked for an explanation from us,” he said.
The ROS previously confirmed that it received an official complaint from Bersatu on Aug 11 over allegations that the party was not involved in the July 16 meeting, as well as issues concerning Bersatu’s membership in Perikatan.
Earlier, senior lawyer Mohamed Haniff Khatri Abdulla said Perikatan could seek an interim injunction to prevent the implementation of the suspension order, particularly if it affected the coalition’s participation in the upcoming Melaka state election.
He said such an application could be made together with a judicial review challenging the validity of the suspension order.
Asked whether the development meant Bersatu had achieved its objective, Takiyuddin did not answer directly.
Instead, he said matters concerning Bersatu’s position in the state governments should be referred to the respective state governments.
“Remember that Bersatu is also in the state governments of Kelantan, Terengganu and Kedah.
“I do not want to comment at length.
That should be referred to the state governments.
They are in state governments led by PAS,” he said.
