GEORGE TOWN: There is no clear provision under the Animal Welfare Act 2015 that makes it an offence for an owner who fails to intervene when dogs fight, says the Penang Veterinary Services Department (DVS).
It had earlier reviewed a complaint and video footage of a fight between two dogs at Pearl Hill, Tanjung Bungah.
"There is no clear provision under the Act that (makes it) an offence by an owner for an animal fight or for failing to stop the fight," it said in a statement on Tuesday (Sept 1).

However, DVS said action could be considered under Section 8 of the Minor Offences Act 1955 if there was evidence that a person had encouraged or prompted an animal to attack.
The provision states that anyone who, without lawful excuse, encourages or prompts a dog or other animal to attack, alarm or frighten any person or animal may be fined.
DVS advised the public to lodge police reports if there was evidence that someone encouraged or prompted an animal to attack.
"This will allow the matter to be investigated and appropriate action taken if an offence is committed under the relevant laws," it added.
The statement came after a video showing a dog attacking a smaller white stray went viral.
The video showed the owner holding the attacking dog's leash as it repeatedly lunged at and bit the stray. The incident is believed to have occurred on Saturday (Aug 29).

The stray, nicknamed Tim, was seen struggling to escape before a woman approached with a long stick and drove the attacking dog away.
Another video showed Tim limping, with its left front leg apparently dislocated, although it could not be confirmed if the injury was sustained during the attack.
It is learnt that Tim was treated at a veterinary clinic and is in stable condition.
After receiving the complaint, the Penang Island City Council (MBPP) seized the dog that reportedly attacked Tim.
Checks found that the dog had a valid licence and was registered as a mixed breed.
