Chegubard files bid to set aside RM550,000 defamation judgment


KUALA LUMPUR: Port Dickson Bersatu chief Badrul Hisham Shaharin is seeking to set aside a High Court judgment ordering him and a YouTuber to pay RM550,000 in damages to businessman Datuk Seri Farhash Wafa Salvador Rizal Mubarak.

Lawyer Muhammad Rafique Rashid Ali, representing Badrul Hisham or better known as Chegubard, said his client only knew about the lawsuit after finding out about the court decision through media reports on Jan 29, adding that his client never received, seen or obtained any writ or letter of demand linked to the suit filed by Farhash.

He said documents were sent via courier service to Badrul Hisham’s former address in Penang but he did not live there and never owned the property.

Badrul Hisham currently resides in Seremban.

“How is it possible that the writ was served when Badrul Hisham said he had no knowledge about the trial date and had never fully seen the suit and demand filed against him," Muhammad Rafique said at a press conference on Wednesday.

Muhammad Rafique said the hearing on Jan 12, where Farhash testified, was "one-sided" as the defendant was not there and unrepresented.

The plaintiff not therefore not cross-examined by the defence.

Badrul Hisham said he was shocked to learn about the judgment but would continue with the court process to defend his rights.

On Jan 29, High Court judicial commissioner Arziah Mohamed Apandi ordered Badrul Hisham and YouTube channel owner Nurpais Ismail to pay a total of RM550,000 in damages and costs.

The award included RM300,000 in general damages, RM150,000 in aggravated damages and RM100,000 in exemplary damages.
