Zuraida seeks review of court ruling in PKR’s appeal against party bond reduction case


KUALA LUMPUR: Former Ampang MP Zuraida Kamaruddin is seeking a review of the Federal Court's decision that granted leave for PKR to appeal a Court of Appeal's ruling that reduced her liability under a party bond from RM10mil to RM100,000.

In the notice of motion filed last month, Zuraida made the application under Rule 137 of the Federal Court Rules 1995.

Lawyer Navpreet Singh, who represented PKR, confirmed the matter.

He said Zuraida's application was to set aside the leave that was granted to PKR and for a re-hearing of PKR's motion to appeal to the Federal Court.

"This review hearing is scheduled to be heard on Dec 11," he said when contacted.

For PKR's main appeal, the Federal Court has fixed hearing for Feb 13, he added.

On June 24, a three-judge panel of the Federal Court granted PKR leave to appeal against an appellate court decision reducing the payment owed by Zuraida who breached a party bond from RM10mil to RM100,000.

On Dec 11, last year, the Court of Appeal upheld the High Court’s ruling that Zuraida had breached the bond, but reduced the quantum payment from RM10mil to RM100,000.

On June 23, 2023, the Kuala Lumpur High Court ruled in favour of PKR and ordered Zuraida to pay RM10mil on grounds that the bond was a valid and binding contract.

The lawsuit was initiated in 2020 by then PKR secretary-general Datuk Seri Saifuddin Nasution Ismail on behalf of the party, claiming Zuraida had violated the terms of a bond she signed before contesting in the 14th General Election in 2018.

Under the bond, among others, Zuraida was required to pay RM10mil to the party within seven days if she resigned from PKR, joined another political party, or became an independent representative after being elected on a PKR ticket.

In her defence, Zuraida contended that she was forced to sign the bond to be able to stand for election as a candidate in the general election under the PKR banner.
