Seremban court jails lorry driver for six years for raping minor


SEREMBAN: A lorry driver, 35, who raped his then underaged girlfriend in a hotel room after forcing her to consume alcoholic drinks received a six-year jail sentence from the Sessions Court, here.

Justice Surita Budin also ordered Khairul Azhar Mohd to be given one stroke of the cane for the offence.

She then sentenced him to three years in jail for possessing two recordings on his mobile phone that showed him sexually abusing the victim who was then four months short of her eighteenth birthday.

The accused had earlier pleaded guilty to both charges.

For the first offence, the accused was charged with raping the victim in a hotel room in Bahau around 12.30am on May 28.

He was charged under Section 376(1) of the Penal Code which carries a jail term of up to 20 years and whipping upon conviction.

For the second offence, he was charged with possessing two video clips of the assault on his mobile phone around 9.30pm on July 31 at the Jempol police headquarters.

He was charged under section 10 of the Sexual Offences Against Children Act 2017 which carries a jail term of up to five years, a fine of not more than RM10mil, or both upon conviction.

Deputy Public Prosecutor Norazihah Asmuni asked the Court to impose a sentence commensurate with the seriousness of the offence.

"The accused not only raped a child but also recorded the assaults on his mobile phone," she said, adding that public interest supersedes his own.

The accused, who was unrepresented, pleaded for leniency as he had to provide for his mother and three young children.

"I hope my prison sentence runs concurrently with another sentence I am already serving now," he said.

DPP Norazihah then told the Court that Khairul Azhar was sentenced to serve five years in jail and be given one stroke of the cane for a drug-related offence in August.

Justice Surita ordered the rape and possession of explicit clips sentences to run concurrently, meaning he serves six years in prison.

She also ordered him to undergo counselling and to remain under police supervision for one year.
