Worker jailed two years for ignoring restriction order


SEREMBAN: A 38-year-old odd job worker was sentenced to two years in jail by the Magistrate's court here after he pleaded guilty to a charge of failing to comply with a restriction order.

Mohd Amirul Afizan Mat did not contest the charge after it was read to him before magistrate Nurul Saqinah Rosli.

The accused, who had been fitted with an electronic monitoring device, was charged with failing to remain in the Setul area during the restriction period from Jan 21, 2022 to Oct 2 last year.

He was charged under Section 15(4) Prevention of Crime Act (amended 2015) (POCA), which carries a jail term of between two and five years.

Mohd Amirul was charged with committing the offence at 10pm on July 27 last year at a carwash at Taman Permai near here.

Deputy public prosecutor Nadia Ezzati Mohd Zainal asked for a punishment commensurate with the offence.

In mitigation, lawyer Syed Fadil Syed Othman from the Legal Aid Department asked for a minimum jail term as the accused, who is a divorcee, had to provide for his 68-year-old mother.

The accused, he said, earned some RM1,500 doing odd jobs.

Earlier, Mohd Amirul had also pleaded guilty to another charge of damaging and throwing away the device at the same place and time.

He was charged under Section 15A(6) of POCA, which carries a jail term of up to three years.

Magistrate Nurul Saqinah then fixed May 21 to deliver judgment. Nik Nur 'Aqilah Syarfa Nik Zaidi prosecuted.
