Daim's complaint being probed under Communications and Multimedia Act, Penal Code, say lawyers


PETALING JAYA: Police is investigating Tun Daim Zainuddin's complaint under Section 233 of the Malaysian Communications and Multimedia Act and Section 505(b) of the Penal Code, according to his lawyers.

Rajesh Nagarajan and Sachpreetraj Singh Sohanpal said in a statement on Wednesday (Oct 9) that they were informed of the matter on Tuesday (Oct 8).

"Section 233 of the Malaysian Communications and Multimedia Act prohibits the use of network facilities to transmit communications deemed annoying to another person, while Section 505(b) of the Penal Code applies to any statement that induces anyone to commit an offence against the State or against public tranquillity," they said.

No investigation, they said, had commenced against the Prime Minister on Daim's complaint for police investigate Anwar Ibrahim over allegations of abuse of power in the wake of a Bloomberg report.

The lawyers said that the police are governed by the Police Act 1967 and are strictly enjoined to uphold the rule of law without fear or favour.

“They must investigate every report fairly and independently. They must be impartial and act fearlessly even if the subject of the investigation is the Prime Minister himself.

“We remind the Inspector-General of Police that under Article 8 of our Federal Constitution, all are equal before the law and equally subject to the criminal law, including the Prime Minister," they said, demanding that

the IGP immediately open an investigation.

The Bloomberg article, citing unnamed sources, had alleged that the Malaysian Anti-Corruption Commission (MACC) received orders to probe Daim, ex-prime minister Tun Dr Mahathir Mohamad, and his sons.

The MACC and the Prime Minister’s Office has since issued statements denying the allegations.

On Sept 26, the Prime Minister’s Office (PMO) denied claims that Prime Minister Datuk Seri Anwar Ibrahim instructed the Malaysian Anti-Corruption Commission (MACC) to investigate Dr Mahathir Mohamad, his sons and former finance minister Tun Daim Zainuddin.

The PMO also denied instructing MACC chief commissioner Tan Sri Azam Baki not to investigate share purchases by Anwar’s former political secretary Farhash Wafa Salvador.
