Woman fined RM8,000 for offensive remarks on Pintasan assemblyman


KOTA KINABALU: A 24-year-old woman was fined a total of RM8,000, in default, 15 months imprisonment for two separate charges of making offensive remarks in relation to Pintasan assemblyman Datuk Fairuz Renddan and insulting the latter on social media platforms.

The accused, Luisa Luis, who is jobless pleaded guilty to the two cases in the court here on Monday (June 10).

In the first charge, Sessions Court judge Amir Shah Amir Hassan sentenced her to a fine of RM5,000, in default, a five-month jail term for her offensive comment on Facebook on April 30 this year.

Victim Fairuz who is the state Assistant Youth and Sports Minister, has seen the post and read her remarks.

She pleaded guilty to the offence under Section 233 (1) (a) of the Multimedia and Communication Act 1998, which is punishable under Section 233 (3) of the same Act.

In the second case, she pleaded guilty to Magistrate Lovely Natasha Charles for insulting Fairuz’s modesty via WhatsApp on April 6, which is an offence under Section 509 of the Penal Code for privacy intrusion.

She was fined RM3,000, in default, 10 months jail.

Fairuz had lodged a police report against Luisa as he was worried, embarrassed and feared for his safety as Pintasan assemblyman.

Luisa who was unrepresented during mitigation, had asked for leniency as this was her first offence and that she would not repeat them again.

The prosecution in response urged the court to impose a deterrent sentence against her, informing that Luisa will also face other upcoming cases to be mentioned on June 28 and July 5.
