Senior citizen acquitted of drug possession charges in Ipoh

IPOH: A senior citizen has been acquitted and discharged of drug possession charges by the Sessions Court here.

For the first charge, self-employed Nur Akil Abd Rahman, 66, was charged for allegedly having in his possession 72.5g of cannabis at a house in Halaman Meru Damai here at about 1.30pm on Jan 29, 2021.

The second charge was for 95.8g of cannabis found under the seat of a car parked near the house at about 2pm on the same day.

Judge Ahmad Kamar Jamaludin said the prosecution had failed to prove a prima facie case.

“The prosecution failed to prove (its case against the accused) beyond reasonable doubt.

“It failed to explain the issue of access to the car where the drugs were found,” he said.

Nur Akil was charged under Section 6 of the Dangerous Drugs Act 1952, which carries enhanced penalties under Section 39A (2) of the Act.

The sentence is between five years' jail and life imprisonment, as well a minimum of 10 strokes of the cane, if found guilty.

The case was prosecuted by Afiqah Izzati Mazlan, while the accused was represented by lawyer Vivien Mitchiel Benedict.
