KUALA LUMPUR: A magistrate’s court has issued a gag order in the case involving two Myvi drivers in an accident which killed a couple and their seven-month-old daughter.
The order was issued following an alleged Facebook post which claimed that the relatives of the victims would settle the case outside court, without the involvement of the police or the court.
The family’s lawyer said yesterday that a police report had been made on the post which was seen on a Facebook page called “Belia Benci Yana Familia Myvi Club”.
Magistrate Noorul Fhaiez Mohd Nayan said: “I am issuing an order prohibiting outsiders, including the media, from discussing unfounded statements until the case is disposed of.”
Lawyer Cantius Leo Camoens said the eldest brother of 35-year-old Fairuz Nizam Husain, who was killed in the crash, had lodged the report after he saw the post on June 8.
Earlier in court, DPP Nadia Malek Fauzie asked for a date to be set for case management as the post-mortem report was not ready.
Noorul set July 31 for case management and Aug 25 and 26 for trial.
On May 8, Siti Noor Aini Mohd Said, 35, and Mohammad Fizal Reza Jamauddin, 31, were charged with causing death by reckless driving under Section 41(1) of the Road Transport Act 1987.
Both pleaded not guilty to the charge.
On May 2, Fairuz Nizam, his wife Nova Safitri Azhari, 25, and their baby girl Nur Firuza Annisa were killed in a crash involving three vehicles at the 6km mark of the DUKE highway.
The couple has two other daughters aged seven and three.
