EQUALITY is firmly embedded in Malaysia’s Federal Consti-tution, alongside specific protections against discrimination. Yet among the grounds listed in Article 8(2) – religion, race, descent, place of birth, and gender – one word remains conspicuously absent: disability.
The country recognises disability through legislation, has made international commitments to protect persons with disabilities, and is strengthening mechanisms against discrimination. Yet our supreme law still does not expressly name disability as a protected ground under Article 8(2).
