P-hailing rider charged with trafficking over 32kg of syabu

KOTA KINABALU: A delivery rider has been charged in the Magistrate's Court here with trafficking more than 32kg of syabu (methamphetamine) in Penampang last month.

The charge against Danial Darwis, 29, was read before Magistrate Marilyn Kelvin on Tuesday (Nov 3) but no plea was recorded as drug cases are under the jurisdiction of the High Court.

Danial is accused of trafficking 32,007.56g of methamphetamine behind a building on Jalan Bundusan, Penampang, at about 8.30pm on Oct 21.

The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39B(2), carries the death penalty, or life imprisonment and 12 strokes of the cane, upon conviction.

The court fixed Dec 21 for next mention of the case.

In an unrelated case, Magistrate Marilyn sentenced 42-year-old Sang Fazar Bunjing, who claimed he cheated a man of RM12,300 in a car sales deal because of financial problems after the Covid-19 pandemic, to 13 months' jail.

The sentence is to take effect from Aug 15, the date the accused was rearrested.

Sang Fazar was charged under Section 417 of the Penal Code with deceiving a man into buying a car that did not belong to him, causing the victim to hand over RM12,300 in cash at Kampung Air here on March 20, 2022.

According to the facts of the case, the victim came across a car advertisement on Facebook Marketplace and contacted Sang Fazar, who offered to sell it.

They subsequently signed a sale and purchase agreement before a Justice of the Peace and the vehicle was handed over, along with its registration card.

However, the victim was later approached by two men at the Inanam Terminal, one of whom was the vehicle's owner, and was told that the car had outstanding loan repayments and subject to repossession.

Sang Fazar broke down in tears while pleading for a lenient sentence, telling the court that his family faced severe difficulties during the pandemic and that his father had been ill and passed away during that period.

He also told the court he was unable to pay his children's tuition fees.

"I ask for a lighter sentence so that I can continue with my life and support my children. Please give me a chance to fulfil my responsibilities as a father," he pleaded.

The court also ordered that the case exhibits be returned to their lawful owner after the expiry of the 14-day appeal period.
