KUALA LUMPUR: The Sessions Court has fixed 15 days from July 26, 2027, for the trial of former Armed Forces chief Tan Sri Mohd Nizam Jaffar, who faces four charges, including abuse of position and criminal breach of trust involving RM3mil.
Judge Rosli Ahmad set July 26 to 29, Aug 9 to 12, Sept 13 to 15 and Sept 27 to 30, 2027, after the prosecution and defence agreed to the trial dates during case mention.
Earlier, deputy public prosecutor Nidzuwan Abd Latip informed the court that the prosecution had handed over all relevant documents to the defence and had been notified of Mohd Nizam's intention to submit a representation.
Meanwhile, counsel Abdul Aziz Hamzah said the defence would submit a representation to the Attorney General's Chambers within a week, but did not elaborate on its purpose.
"We will also file a defence statement under Section 51A of the Criminal Procedure Code. We request that the court set a date to hear the outcome of the representation," the lawyer submitted.
The court then set Oct 28 for further mention of the case to monitor the progress of the representation.
Mohd Nizam, 59, is accused of using his position as assistant chief of staff for Member Services of the Malaysian Armed Forces to obtain a bribe of RM267,481.90 for himself.
He allegedly did so in his capacity as chairman of the Armed Forces Welfare Fund (TKAT) executive committee by appointing Sinar Bakti Global for the "supply of batik fabric for 2025 Hari Raya parcels" worth RM468,000.
He is also accused of appointing Sinar Raudhah Global for "supply of batik fabric for 2025 Hari Raya parcels" worth RM52,000.
He likewise allegedly appointed Zahra Jaya Global for "supply of multifunctional folding pliers for 2025 Hari Raya parcels" worth RM750,000, for the fund, in which he had an interest.
Mohd Nizam is further accused of using his position to obtain a bribe of RM285,000 for himself by appointing QMZ Resources for the "supply of bath towels for 2025 Hari Raya parcels" worth RM600,000.
He allegedly also appointed Helmee Resources for the "supply of backpacks for 2025 Hari Raya parcels" worth RM1,725,000.
The first two offences are alleged to have been committed at the Defence Ministry, Jalan Padang Tembak, Kem Kementah, on June 24, 2024.
For this, he was charged under Section 23(1) of the Malaysian Anti-Corruption Commission Act 2009, which provides for a maximum imprisonment of 20 years and a fine of not less than five times the amount or value of the bribe or RM10,000, whichever is higher, upon conviction.
For the third charge, Mohd Nizam is accused of committing criminal breach of trust involving RM3 million belonging to the fund by misusing the funds to make additional investments in Precious Amber International Berhad without approval from the TKAT investment committee, at the same location, on Oct 4, 2024.
This charge was brought under Section 409 of the Penal Code [Act 574], which provides for imprisonment of not less than two years and up to a maximum of 20 years, caning and may also be liable to a fine.
According to the fourth charge, Mohd Nizam is accused of accepting RM200,000 without consideration from a director of Aspen Red Sdn Bhd, who may have been involved in transactions to be carried out by him, at Wisma Transit Kuala Lumpur, Jalan Buku Lima, Kem Kementah, in March 2025.
This charge was framed under Section 165 of the Penal Code, which carries imprisonment of up to two years, or a fine, or both upon conviction. – Bernama
