KUALA LUMPUR: Gombak Setia assemblyman Muhammad Hilman Idham was acquitted and discharged by the Magistrate’s Court here Wednesday (Sept 9) of a charge of making a statement on TikTok that allegedly could cause public alarm.
Magistrate Nurul Izzah Hasan Basri found that the prosecution had failed to establish the essential elements of the charge under Section 505(b) of the Penal Code.
"In conclusion, the prosecution has failed to establish a prima facie case against the accused at the close of the prosecution’s case. Therefore, the accused is acquitted and discharged without being called to enter his defence. The RM4,000 bail is to be returned,” said Nurul Izzah.
According to the charge, Muhammad Hilman was alleged to have made a statement on TikTok that could cause public alarm and induce any person to commit an offence against public order at 2.09pm on July 30, 2025.
The video link was allegedly viewed by a police officer from the Commercial Crime Investigation Department at Menara KPJ here.
He was charged under Section 505(b) of the Penal Code, which carries a maximum jail term of two years, or a fine, or both, upon conviction.
At today’s proceedings, the accused was represented by lawyers Muhammad Rafique Rashid Ali and Nur Mustanir Md Nor, while the prosecution was conducted by Deputy Public Prosecutor Nurul Farhanah Arul Hisham. - Bernama
