21-year-old pleads not guilty to sexually assaulting teenaged sister


MELAKA: A 21-year-old youth claimed trial at the Session Courts in Ayer Keroh here to two counts of sexually assaulting his teenage sister.

Both offences were allegedly committed just 30 minutes after the unemployed accused was released from Henry Gurney School here, where he had served more than two years for raping another sister.

The accused's plea to the two charges of sexually assaulting the 15-year-old girl on separate occasions was recorded before Judge Raja Noor Adilla Raja Mahyaldin on Friday(Aug 28).

On the first charge, the accused allegedly kissed, fondled the victim and sexually assaulted her at a house in Kampung Umbai, Merlimau, in the Jasin district, at about 1pm on June 6.

The offence was allegedly committed about 30 minutes after he was released from Henry Gurney School at 12.30pm that day.

The accused had served more than two years at the juvenile correction institution after being convicted of raping another younger sister, who was 15 at the time of the offence.

On the second charge, he allegedly pulled down the same victim’s trousers and pressed his body against hers at the same house at about 9.30pm on Aug 20.

Both charges were framed under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries a maximum jail term of 20 years and whipping upon conviction.

Deputy public prosecutor Rif’ah ‘Izzati Abdul Mutalif proposed bail of RM15,000 for each charge.

She also requested the court to prohibit the accused from approaching or harassing the victim and to require him to report to the nearest police station once a month.

The accused, who was unrepresented, appealed for lower bail, saying he had only recently been released.

The court granted bail of RM9,000 in one surety for both charges and imposed the additional conditions requested by the prosecution.

The court also fixed Sept 29 as the next mention date.
