Daim’s family and lawyers sue over alleged plot


KUALA LUMPUR: The family of the late Tun Daim Zainuddin and two lawyers have filed a legal action against the Prime Minister, the Inspector-General of Police and the government over what they claimed to be unlawful investigation against them, linked to an alleged plot to overthrow the government.

Daim’s wife Toh Puan Na’imah Abdul Khalid, their two sons Mu­ha­mmed Amir Zainuddin and Muhammed Amin Zainuddin along with lawyers Amir Zharif Abdullah and Muhammad Niza­mud­­din Abdul Hamid filed the originating summons at the High Court through Messrs Raj & Sach yesterday.

They named Prime Minister Datuk Seri Anwar Ibrahim, IGP Datuk Seri Mohd Khalid Ismail and the government as the first, second and third defendants, respectively.

In the originating summons, sighted by The Star, the plaintiffs are seeking a court declaration that an investigation under Sec­tion 124B of the Penal Code by the IGP and the government against them is unlawful, unconstitutional and tainted with bad faith.

The plaintiffs are seeking a court declaration that Section 124B of the Penal Code and Section 130A(a) of the Penal Code are unconstitutional, and certain wordings in the provisions are vague, overbroad and ambiguous, thus contravenes Articles 5 and 8 of the Federal Constitution.

Lawyers for the plaintiffs, Rajesh Nagarajan and Sachpreet­raj Singh, said in a statement that the suit was filed in public interest, to challenge abuse of power and to put a stop to the false claims of a “Zionist plot” to overthrow the government.
