Guard pleads guilty to 13 sexual offences against 6YO daughter

JOHOR BARU: A school security guard pleaded guilty to 13 counts of sexual offences against his six-year-old illegitimate daughter.

The 43-year-old man entered the plea in the Sessions Court here on Monday (March 2) to all the charges, which took place from Jan 22 to Feb 17 at his squatter home in Kempas.

He was accused of raping the girl on the morning of Feb 17, an offence under Section 376(3) of the Penal Code, which carries a minimum sentence of eight to 30 years’ jail and at least 10 strokes of the cane upon conviction.

He was accused of four counts of physical sexual assault and four counts of non-physical sexual assault against the victim.

He was also slapped with two charges of carnal intercourse against the order of nature, and two counts of recording child sexual abuse materials.

The charges were filed under various sections under the Sexual Offences Against Children Act 2017 and the Penal Code.

The man, whose head was bowed throughout the proceedings, said he understood the charges and pleaded guilty.

Deputy public prosecutors Nur Farah Wahida Shahudin and S. Manushri told the court that no bail was offered as the offences were non-bailable.

Sessions judge Mohd Zamir Suhaimee agreed and fixed Wednesday (March 4) for the decision to be read.

Separately, in a different court, the security guard’s 46-year-old girlfriend was accused of neglect where she, as the victim’s guardian, exposed the child to physical harm.

It is learnt that the victim is the couple’s child born out of wedlock.

The woman, who works as a restaurant helper, pleaded not guilty to the charge under Section 31(1)(a) of the Child Act 2001, which carries a fine of up to RM50,000 or a maximum jail term of 20 years, or both, upon conviction.

Sessions judge Ahmad Kamal Arifin Ismail allowed her bail of RM8,000 with one surety, and fixed April 2 for next mention.
