Ex-guard pleads guilty to sending obscene messages to woman in Ipoh

IPOH: A former security guard has been charged at the Sessions Court here with three counts of sending obscene messages to a woman two years ago.

Syed Danian Syed Mustapha Basri, 42, pleaded guilty after the charges under Section 233(1)(a) of the Communications and Multimedia Act were read before Judge Ainul Shahrin Mohamad on Thursday (Feb 12).

The accused was said to have committed the acts on Dec 13 and 14, 2024.

Malaysia Communications and Multimedia Commission (MCMC) deputy public prosecutor Fadhli Ab Wahab said the offence committed by the accused was serious as it could cause the victim to feel humiliated and affect her psyche.

"The messages are explicit and could cause emotional stress and fear to her. It's not just an obscene message, but an intrusion to someone's dignity and psyche," he said.

"She may not feel safe at work or at home because of the harassment. The act was also repeated, so we urge for a maximum penalty," he added.

Syed Danian, who was unrepresented, pleaded for leniency, noting that he was taking care of three children.

"One of them is a person with disability. I will not repeat the act," he said.

Ainul set the fine at RM10,000 in default five months jail for each of the charges. MCMC prosecuting officer Nadzirah Idris was also present.
