SHAH ALAM: Zayn Rayyan Abdul Matin’s mother failed to suspend a five-year jail sentence imposed on her by a Sessions Court for neglecting her autistic child two years ago.
The High Court dismissed Ismanira Abdul Manaf’s bid to stay the jail term meted out in October by the Petaling Jaya Sessions Court after finding that there were no special circumstances that would allow the court to grant the order pending the appeal.
High Court judge Justice Aslam Zainuddin said: “After examining the affidavits of the applicant and respondent, as well as the written submissions of both parties and hearing the oral submissions, the court ruled that the application for a stay of execution be dismissed because the court found that there were no special circumstances to allow it.”
The prosecution, as the respondent, was represented by deputy public prosecutors Mohd Izham Ali and Ahmad Iqbal Azman, while Ismanira was represented by lawyers Haresh Mahadevan, Ramzani Idris and Lavanesh Haresh.
Ismanira, 30, filed the application for a stay of execution on Nov 19, Bernama reported.
On Oct 31, the Petaling Jaya Sessions Court ordered Ismanira, 30, to serve her prison sentence starting from the day of sentencing, in addition to signing a two-year good behaviour bond with one surety and a security of RM3,000.
Ismanira was also ordered to perform 120 hours of community service, to be completed within six months of completing her prison sentence.
Ismanira was found guilty of neglecting Zayn Rayyan, six, in a manner likely to cause physical harm.
She has been convicted for committing the offence in the area of Block R, Pangsapuri Idaman, Damansara Damai, up to the nearby river area, between 12pm, Dec 5, 2023, and 9.55pm, the next day.
On Dec 6, 2023, Zayn Rayyan was found dead in a stream near the Idaman Apartment area, Damansara Damai, at 10pm.
The victim was previously reported missing before the body was found, about 200m from the residential block.
