Court defers judgment to allow accused to celebrate Deepavali


SEREMBAN: The Sessions Court here deferred its judgment involving a 41-year-old barber charged with causing grievous hurt to another man with a machete after the defence asked that the accused be allowed to celebrate Deepavali with his loved ones next week.

Judge Meor Sulaiman Ahmad Tarmizi allowed the application by lawyer B.G Jayaprakash representing the accused S. Kokulan, although the court was scheduled to deliver judgment the same day on Thursday (Oct 16).

Jayaprakash said that while the defence did not know how the court would rule, it still hoped the request would be granted.

"With Deepavali just a few days to go, both the accused and I would like to plead to the court for another date to deliver judgment.

"Although we do not know what the outcome of this case is, we hope this request is granted," he said.

Kokulan was charged with committing the offence against the victim, who was then 35, in front of his outlet around 10.58pm on Dec 17, 2021.

He had been asked to enter his defence to the charge.

The accused was charged under Section 326 of the Penal Code for causing grievous hurt with a dangerous weapon, which carries a jail term of up to 20 years and a fine or whipping upon conviction.

Deputy Public Prosecutor Siti Khairiah Abdul Razak then got up to say she was leaving it to the court's discretion.

Judge Meor Sulaiman then allowed the request and fixed Nov 13 to deliver his decision.
