Ustaz gets jail and rotan over rape of minor


KUALA LUMPUR: A freelance preacher will be serving a 15-year jail sentence and be given three strokes of the rotan after he was found guilty of raping and molesting a 13-year-old girl.

The Sessions Court held that Muhammad Fathi Na’im Mazlam, or better known as Ustaz Fathi Na’im, had failed to raise a reasonable doubt at the end of his defence case.

“After hearing submissions from both parties, the court is satisfied with the testimonies throughout the trial. The accused is found guilty and convicted of all three charges,” Sessions judge Noridah Adam ruled yesterday.

The court then sentenced Ustaz Fathi Na’im to 15 years in jail and a stroke of the rotan for each of the charges.

Noridah ordered for all three sentences to run concurrently from the date of sentencing.

According to the first and second charge sheets, Ustaz Fathi Na’im had raped the minor, who was 13 then, inside a vehicle at the parking lot at Dataran Eco World, Bandar Baru Puncak Alam, Kuala Selangor, Selangor, on two occasions at 3pm and 7pm in July 2021.

He is convicted under Section 376(1) of the Penal Code which carries a maximum 20 years imprisonment and whipping.

He is also convicted of one count of molesting the same child at the same place in June 2021.

He was charged under Section 14(a) of the Sexual Offences Against Children Act 2017 which carries a maximum 20 years imprisonment and whipping.
