PUTRAJAYA: The Federal Court has granted a stay on a decision by the Court of Appeal in a land dispute between Semantan Estate Sdn Bhd (SESB) and the government involving a plot of land known as the "Duta Enclave".
On June 24, the Government and the Federal Territory Registrar of Titles succeeded in their appeal to set aside an order by the High Court requiring them to transfer ownership of the land to SESB.
On Friday, the Federal Court’s three-judge panel, chaired by Chief Judge of Malaya Justice Hasnah Mohammed Hashim, allowed for the appellate court's decision to be stayed pending SESB's application for leave to appeal at the apex court.
She ordered parties to file submissions and replies by September 29. The hearing date for the leave application was fixed for Nov 6.
Other judges on the panel were Justices Zabariah Mohd Yusof and Vazeer Alam Mydin Meera.
Earlier, lawyer Datuk Dr Cyrus Das informed the court that all parties had agreed to the stay pending the company’s application for leave to appeal to the Federal Court.
The parties agreed that SESB be allowed to suspend the decision that had allowed the Government and the Registrar of Titles’ appeal to set aside the order requiring transfer of the land, as well as the compensation assessment proceedings.
This was confirmed by Senior Federal Counsel Shamsul Bolhassan, who acted for the Government and the Registrar of Titles.
