Aliff Syukri acquitted of four counts of uploading offensive content


SEPANG: Cosmetics entrepreneur Datuk Seri Aliff Syukri Kamarzaman has been acquitted by the Sessions Court here of four counts of uploading offensive content on his Instagram relating to his controversial music video titled "Kelepok Raya".

Sessions Court judge Ahmad Fuad Othman made the order of a discharge and acquittal (DNA) after considering additional submissions from both the defence and prosecution.

On Oct 13, 2022, Aliff Syukri was accused of producing and uploading the Kelepok Raya music video with the intention of offending others via his Instagram account @aliffsyukriterlajaklaris.

The five-minute, 23-second video, which featured male dancers in make-up, drew criticism at the time for being inappropriate during the Hari Raya celebrations.

Aliff Syukri was accused of four counts of uploading four clips – all in relation to the music video – with intent to annoy others.

He allegedly posted the content on his Instagram account with the handle "aliffsyukriterlajaklaris" between April 13 and 21, 2022.

The clips were then viewed at the Malaysian Communications and Multimedia Commission headquarters in Cyberjaya on April 21, 2022.

All of the charges were framed under Section 233(1)(a) of the Communication and Multimedia Act 1998 whereby Aliff Syukri faced a maximum RM50,000 fine or a maximum of one year in jail, or both, if convicted.

He also faced a fine of RM1,000 for each day the offence continues after a conviction.

He was ordered to enter his defence on March 14, this year.
