High Court to decide on SRC International's RM19.5mil lawsuit against Umno on Oct 24


KUALA LUMPUR: The High Court has fixed Oct 24 for its decision in a civil action filed by SRC International Sdn Bhd and its two subsidiaries against Umno and Selangor Umno over RM19.5mil in funds they received in 2015.

Justice Raja Ahmad Mohzanuddin Shah Raja Mohzan set the date following a two-day hearing for submissions by the parties involved in the suit.

"Thank you to the parties for your extensive submissions. I will deliver my decision at 9am on Oct 24," he announced on Wednesday (July 30).

Earlier, the court heard submissions from Selangor Umno's lawyer, Datuk Hasnal Rezua Merican, who argued that there was no doubt the RM3.5mil funds came to Selangor Umno as a political donation.

Lawyer Mohamed Shahrul Fazli Kamarulzaman, representing Umno, reiterated that Umno received the RM16mil and used it for activities and programmes under the political party's corporate social responsibility (CSR) initiatives.

Meanwhile, lawyer Razlan Hadri Zulkifli submitted that the plaintiffs had proven their case on breach of fiduciary duties by the defendants.

"Based on the admission by former SRC International director Datuk Suboh Md Yassin (the second SRC witness) himself in signing blank cheques, and the documentary evidence presented before this court, the plaintiffs have proven there was a breach of trust or duties by the former directors of the plaintiffs on the balance of probabilities," he stated.

In May 2021, SRC and its two subsidiaries, JPSB and Gandingan Mentari Sdn Bhd (GMSB), filed two separate lawsuits against Umno and Selangor Umno.

In the lawsuit against Umno, the plaintiffs are seeking RM16mil, claiming it was wrongfully transferred to the political party, asserting that Umno had no basis to receive the funds.

The second lawsuit involves a claim for RM3.5mil against Selangor Umno, which is also alleged to have received the funds improperly.
