Strict process for switching foreign workers’ employers


PETALING JAYA: The process of switching employers for foreign workers requires going through a strict process and adhering to the SOP, according to an Immigration Department official.

The official, who declined to be named, said there were several criteria to be met before an employer could apply to do so.

“Each case will be assessed according to the established procedures,” said the official.

The conditions include the employer being unable to sustain the foreign worker anymore, the original employer having passed away, been declared bankrupt or ceasing business operations.

“The employer switch application must involve both the original and new employers.

“Both employers must agree to release or accept the foreign worker and the agreement document must be stamped,” the official explained.

The official said employer swaps were only allowed within the same sector.

The official added bosses must obtain a support letter from the Labour Department before submitting an application to the Home Ministry for processing.

“If the application is incomplete, disorganised or does not meet any of the set criteria, the ministry has the right to reject it,” said the official.
