PUTRAJAYA: The Election Commission welcomes a court decision that the commission's calling for a by-election in Semenyih was in accordance with the law.
EC chairman Azhar Azizan Harun (pic) said that with the decision, the by-election would go on as planned.
Polling day for the Semenyih by-election is March 2 (Saturday).
The Shah Alam High Court had on Monday (Feb 25) rejected an originating summons filed by a voter to stop the EC from going ahead with the Semenyih by-election
Sabariah Mohd Shariff had named the EC, Azhar and the federal government as defendants.
In her originating summons, Sabariah had sought a declaration that the EC does not exist and had become illegal or unconstitutional after Jan 1.
This is because after that date, the commission was functioning only with Azhar as the chairman with no deputy nor were there commissioners.
The EC had met and decided on the key dates for the by-election on Jan 18.
The vacant posts have since been filled.
