KUALA LUMPUR: Former prime minister Datuk Seri Najib Tun Razak pleaded not guilty at the High Court here to three charges of criminal breach of trust (CBT) in his capacity as Prime Minister, Finance Minister and Advisor Emeritus of SRC International, in which he was entrusted with RM4bil.
He is alleged to have misappropriated funds through various banks in Malaysia on three occasions between Dec 24, 2014 and March 2, 2015; amounting to RM27mil, RM10mil and RM5mil.
SRC International was a subsidiary of 1MDB, and was placed under the jurisdiction of the Finance Ministry in 2012.
The prosecution team, which is led by Attorney General Tommy Thomas, includes Datuk Mohamad Hanafiah Zakaria, Manoj Kurup, Datuk Suhaimi Ibrahim, Datuk Umar Saifuddin Jaafar, Datuk Ishak Mohd Yusoff, Donald Joseph Franklin, Muhammad Saifuddin Hashim Musaimi, Budiman Lutfi Mohamed, Sulaiman Kho Kheng Fuei, Mohd Ashrof Adrin Kamarul and Muhammad Izzat Fauzan.
The defence team, lead by Tan Sri Dr Muhammad Shafee Abdullah, includes Harvinderjit Singh, Datuk R. Krishnan, Farhan Read, Rahmat Hazlan, Muhammad Farhan Shafee and Syahirah Hanapiah.
3.27pm: Najib and his convoy have left the court grounds.
3.25pm: Najib leaves the courthouse escorted by police. He was met by hundreds of supporters chanting "Hidup Najib".
1.40pm: Attorney General Tommy Thomas addresses the media outside the High Court where Najib was charged. "I never expected that (the commotion). Hopefully, it was recorded and uploaded online for posterity so that everyone can make up their mind (about what happened)," he says.
12.55pm: What was supposed to be a press conference by Attorney General Tommy Thomas had to be cancelled due to security purposes when supporters of Datuk Seri Najib Tun Razak turned rowdy. They chanted “Bahasa Malaysia” when Tommy spoke in English. The crowd then shouted “Melayu” and “Hidup Melayu” to drown out Tommy’s voice until he had to be escorted away.
12.43pm: The court has fixed 19 days for trial between February and March next year (Feb 18 - 28; March 4 - 8, March 11 - 15, 2019) to hear Najib's case.
12.32pm: Aug 8 fixed for case management.
12.24pm: Court granted Shafee's request for an interim gag order against both digital and print media from discussing merits of the case.
11.53am: Bail for Najib fixed at RM1mil in cash and two sureties. He will also surrender both his normal and diplomatic passports. Najib's lawyer says bail payment of RM500,000 will be made today and the balance of RM500,000 be made before 3pm on Monday.
10.57am: Shafee says his client has "unblemished record", an MP since 1976, served as Pahang MB etc, doesn't even have a traffic offence.
10.52am: Shafee objects that bail amount is too high. He says that his client is not a flight risk.
"My client through his children and wife have to ask around from their relatives to raise money," says Shafee, who requests bail to be set at RM500,000 to RM800,000.
10.48am: Tommy Thomas requests that bail be set at RM1mil for each charge, making for a total of RM4mil.
10.46am: All three CBT charges read out. Najib pleads not guilty.
10.40am: Najib pleads not guilty to a charge under Section 23 of the MACC Act 2009.
10.39am: Case transferred to High Court. Charges being read out in front of judge High Court judge Justice Mohd Sofian Abd Razak.
10.17am: Defence and prosecution teams are in. 10.16am: Najib leaves courtroom.
10.14am: Nooryana Najwa and her husband Daniyar Nazarbayev, and Norashman are seen in the courtroom.
9.50am: Though no plea was recorded, Najib nods to show he understood the charges read out to him. He appears grim, with his jaw drawn tight.
9.37am: Najib charged with three counts of criminal breach of trust and one count of using his position for gratification.
9.15am: Charges are being read out.
9.05am: Court proceedings underway. Najib is dressed in blue suit and white shirt.
9.04am: Tan Sri Dr Muhammad Shafee Abdullah appears in court with Najib's defence team.
8.30am: Police are allowing media into the courtroom. Two rows of benches that can seat around 25 reporters are provided. The two front rows of the public gallery are reserved for Najib's friends and family.
8.25am: Najib arrives at Jalan Duta Courts complex.
8.05am: More than a dozen police personnel are stationed outside the Sessions Court where Najib is expected to be charged. They instruct reporters to register a representative per publisher, due to limited seats in the courtroom.
6.55am: Court gates open to allow a convoy of police vehicles to enter. Police officers from the canine unit are also seen inspecting the car park and courts complex, while officers use metal detectors on nearby plant pots and garbage bins.
