Tribunal orders developers to pay over RM100,000 to housebuyers in Sarawak 


THE Sarawak Housing Claims Tribunal in Sibu has ordered three developers to pay a total of RM101,069.81 to housebuyers in three separate cases.

The offences were for breach of contract and poor work quality of their new homes.

Tribunal president Trabawan Mandi and panel members Datuk Alhadi Ibrahim and Mohamad Abdul Aziz Ariffin presided over the cases.

The first case involved Mohd Awissolqani Abdul Razak, who sought RM26,040 for late delivery and poor workmanship of his property in Jalan Oya, Sibu.

The claimant told the Tribunal that the sale and purchase agreement (S&P) for the house costing RM310,000 was signed on May 20, 2020.

He said the property was supposed to have been completed in Feb 21, this year.

The Tribunal ordered the developer to pay RM23,390 to the claimant.

Trabawan also ordered a different developer to pay another housebuyer, Zulkanain Jemat, RM49,393.97 for late delivery of a property.

Zulkanain, in filing his case, told the Tribunal that the S&P for the RM398,000 double-storey intermediate house in Seduan Land District was signed on Sept 3, 2020.

He was supposed to get the house in 24 months but the developer failed to meet the deadline.

Third case involved two-joint buyers, Muhamad Pauzee Sapili and Nur-anita Maslan, who together filed a claim for RM33,600 for late delivery of their RM388,000 house in Seduan Lane.

The Tribunal ordered the developer to pay the duo a sum of RM28,285.

The S&P for the house was signed on July 12, 2013 while the Certificate of Completion and Compliance was only issued on Feb 13, 2025.

The property was handed over on Feb 21, 2025.

The Tribunal ordered that the compensations be paid within 45 days from Oct 22 for all three cases.

Failure to do so may result in prosecution.

If found guilty, the respondents shall be liable to a fine not exceeding RM5,000, or jailed not more than two years, or both, pursuant to Section 53(1) of Housing Development Ordinance (Control and Licensing) 2013.
